Full job description
Superhuman offers a dynamic hybrid working model for this role. Superhuman team members in this role must be based in San Francisco Bay Area, and they must be able to collaborate in person 2 days a week.
The Opportunity As the Employment & Benefits Counsel, you will:

Advise People and business teams on employment matters across the U.S., Canada, and Latin America, including hiring, performance management, accommodations, leaves, investigations, organizational changes, and terminations. Work with local counsel as needed.

Advise and partner with the Payroll team on wage and hour compliance, including classification, overtime, and other wage-related issues.

Manage employment disputes from initial demand through resolution, including litigation, arbitration, regulatory enforcement, and pre-litigation claims. Develop case strategy, manage outside counsel and budgets, oversee litigation holds and discovery, and coordinate responses with insurance carriers.

Conduct or oversee workplace investigations and advise on findings, remediation, and related employment decisions.

Advise on executive compensation and employee benefits programs, including offer letters, separation agreements, incentive and commission plans, liquidity agreements, and health, welfare, and retirement plans.

Support the company’s equity compensation programs and advise on employee liquidity programs and related arrangements, including tender offers, in partnership with Legal, Finance, People, and Equity teams.

Advise on employment, benefits, and executive compensation matters in M&A and other strategic transactions, including workforce and contractor diligence, equity and incentive arrangements, liquidity agreements, and related deal documentation, closing, and integration.

Partner with People, Finance, Equity, and business teams to build practical programs, guidance, training, and processes that support consistent employment, compensation, benefits, equity, and liquidity practices.

Monitor legal developments across the U.S., Canada, and Latin America and advise on their impact on the company’s workforce, programs, and transactions.
Qualifications

At least 3 years of legal experience, including hands-on experience advising on employment law matters and managing employment disputes, whether in-house or at a law firm.

A J.D. from an ABA-accredited law school and an active license in good standing to practice law in at least one U.S. jurisdiction.

Experience handling sensitive employment matters, such as investigations, agency enforcement actions, demand letters, litigation, or workplace complaints.

Strong legal writing and drafting skills, including experience preparing or reviewing employment agreements, policies, or practical guidance for business partners.

The judgment to assess legal and business risks, give clear and practical advice, and handle confidential matters with discretion.

The ability to work independently, manage competing priorities, and move matters forward with limited direction.

Strong communication and relationship-building skills, with the ability to work effectively with People, Finance, and other cross-functional teams.
We’d also value

Experience or exposure to executive compensation, employee benefits, equity compensation, or employee liquidity programs.

Experience supporting the employment or executive compensation aspects of a merger, acquisition, or other strategic transaction.

Familiarity with employment law issues in Canada or Latin America, or experience coordinating with local counsel on cross-border matters.

Experience at a technology company or another fast-growing, global organization.
