Summary

This position is located in the Appellate and Supreme Court Litigation Branch of the Division of Enforcement Litigation. The Branch conducts the litigation in the U.S. Court of Appeals involving the enforcement or review of Board Orders. The incumbent serves as a General Attorney (Labor) working under the supervision of the Branch Chief or a Supervisory Attorney, preparing assigned cases involving enforcement litigation in the U.S. Court of Appeals, and litigation in the U.S. Supreme Court.

Duties

As a General Attorney (Labor) (Appellate Litigation Attorney), GS-0905-14, your typical work assignments may include: Analyzing the entire record including the proceedings, exhibits, the Administrative Law Judge's decision, and the Board's decision and order. Conducting extensive legal research and investigating the facts as well as the laws, regulations and legal precedents. Preparing briefs containing a concise statement of the facts of the case and the presentation of the legal argument, including requisite citation of authority, in the manner deemed most likely to persuade the Court to sustain the Board's position. Representing the Board and presenting oral arguments in the Court of Appeals in assigned cases. Analyzing applicable law and facts in order to develop sound rationales for the disposition of the most difficult and novel questions of law, policy, and procedures that arise in the enforcement of the Act. Independently analyzing cases to determine if opposing briefs need to be filed or if a rehearing by the Supreme Court is needed. Qualifications

All qualifications and eligibility requirements must be met by the closing date of the announcement. IDEAL CANDIDATE STATEMENT The ideal candidate for the General Attorney (Labor) will have working knowledge in traditional labor or employment law. The candidate has demonstrated an ability to provide expert legal analysis and advocacy in an efficient manner on complicated matters. The candidate has experience drafting complex legal arguments and has exemplary legal research and written and oral communications skills. BASIC REQUIREMENT Education: Must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LL.B. or J.D.). Law school transcripts must be submitted at the time of application. Bar Membership and Certification: Must currently be a member in good standing of the bar of a state, territory, or commonwealth of the United States, District of Columbia, or Commonwealth of Puerto Rico. Your active Bar license must reference Bar number and indicate the status of good standing. Agency Internal Self-Certification Forms are not acceptable for verification. In addition to the BASIC REQUIREMENT, applicants must also meet the following: MINIMUM QUALIFICATIONS Applicants must have one year of specialized experience, equivalent to the GS-13 grade level, which has provided them with the knowledge, skills, and abilities to successfully perform the duties of a General Attorney (Labor) (Appellate Litigation Attorney) at the GS-14 grade level. Specialized experience includes: Experience independently working with federal labor law (e.g., the National Labor Relations Act, the Federal Labor Relations Act, or Equal Employment Opportunity statutes) or state labor laws to provide guidance and recommendations on case law; and Experience independently researching statutes, decisions, opinions, or legislative history to ensure the appropriate use of legal authorities; and Experience independently drafting legal memoranda or briefs; and Experience independently presenting oral arguments or making other oral presentations recommending disposition of cases. This experience must be fully supported and articulated in your resume to receive consideration. Phase 3: Applicants who successfully pass the Structured Resume Review assessment may be advanced to a Writing Sample Review conducted by a Subject Matter Expert (SME) panel. SMEs may assess applicants' ability to demonstrate the required competencies for the position. Phase 4: A final score, which may combine the results from one or more assessments, may be used to identify the top-rated applicants. Applicants meeting the established cut-off score may be referred to the selecting official for consideration and may be required to participate in one or more additional interviews as part of the hiring process. THE RULE OF MANY The NLRB uses the Rule of Many which ranks job applicants numerically and allows for selection from a broader, top-ranked pool.
